This Privacy Policy describes how SellerAI, Inc. ("SellerAI," "we," "us," or "our") collects, uses, discloses, and otherwise processes personal information through our website located at sellerai.com, the SellerClaw software-as-a-service product located at app.sellerclaw.ai, related dashboards, APIs, integrations, communications, and other related services (collectively, the "Services").

This Privacy Policy applies to information we collect from website visitors, prospective customers, customers, account users, and other individuals who interact with us.

By using the Services, you acknowledge the practices described in this Privacy Policy.

2. Scope of This Privacy Policy

This Privacy Policy covers information collected through:

  • our public website and landing pages;
  • account registration and administration for SellerClaw;
  • billing, payments, and subscription management;
  • customer support, onboarding, and communications;
  • integrations with third-party platforms, including Amazon Selling Partner API, eBay APIs, Shopify API, and Google APIs (including Google Sign-In and the Google Ads API); and
  • analytics, cookies, advertising, and similar tracking technologies used in connection with the Services.

This Privacy Policy does not apply to third-party websites, services, marketplaces, payment providers, advertising networks, or APIs that you may connect to the Services. Those third parties maintain their own privacy policies and terms.

3. Personal Information We Collect

3.1 Information You Provide Directly

We may collect the following categories of personal information that you provide directly to us:

  • name;
  • email address;
  • phone number;
  • company name;
  • billing address;
  • account credentials and authentication information;
  • subscription, billing, and transaction-related information;
  • communications you send to us, including support requests, feedback, and other correspondence; and
  • any other information you choose to submit through the Services.

3.2 Information We Collect Automatically

When you use our website or Services, we and our service providers may automatically collect certain information, including:

  • IP address;
  • browser type and version;
  • device type and identifiers;
  • operating system;
  • pages viewed, links clicked, and referring URLs;
  • dates, times, and duration of visits and sessions;
  • usage patterns and interaction data within the Services; and
  • information collected through cookies, pixels, tags, SDKs, and similar technologies.

3.3 Information From Connected Integrations

If you connect third-party services to SellerClaw, we may collect and process data made available through those integrations, including through Amazon Selling Partner API, eBay APIs, Shopify API, and Google APIs. Depending on the permissions granted and the features used, this may include:

  • store, seller, and account profile information;
  • product listings, catalog data, and inventory data;
  • orders, fulfillment information, shipment information, returns, and related operational data;
  • customer-facing transaction data such as customer names, shipping addresses, phone numbers, and order details;
  • advertising account information, campaign data, and related performance statistics;
  • store performance, analytics, and marketplace-related data; and
  • other information made available to us through authorized API access.

Data accessed specifically through Google APIs ("Google user data") is described in detail in Section 4 (Google User Data and API Services) below.

3.4 Payment Information

Payments for the Services are processed by third-party payment processors, including Stripe. We do not store full payment card numbers on our own systems unless expressly stated otherwise. Payment information is collected and processed by the relevant payment processor in accordance with its own terms and privacy practices.

3.5 AI-Related Inputs and Outputs

We may collect prompts, instructions, files, content, operational data, and other inputs you submit to AI-enabled features of the Services, as well as outputs generated in response. This may include business information, store information, product content, workflow data, and other materials you choose to provide. Google user data is excluded from these AI training and improvement uses, as described in Section 4.4 below.

4. Google User Data and API Services

This section describes how SellerAI accesses, uses, stores, shares, retains, and deletes data obtained through Google APIs ("Google user data"). This section governs Google user data and controls over any more general statement elsewhere in this Privacy Policy. SellerAI's access to and use of Google user data complies with the Google API Services User Data Policy, including its Limited Use requirements, and with the Google APIs Terms of Service.

4.1 Google User Data We Access

When you choose to connect your Google account to SellerClaw, and only with your authorization through Google's OAuth consent screen, we access the following categories of Google user data:

  • Account identity (Google Sign-In): your email address and full name, which we use to authenticate you and to create and manage your SellerAI account.
  • Google Ads data (Google Ads API): information about the Google Ads accounts you authorize, including account details, advertising campaigns, ad groups, ads, keywords, budgets and spend, and related performance statistics and reporting metrics.

We only request the minimum permissions (OAuth scopes) necessary to provide the features described below, and we request them in context so that you understand why each permission is needed. If we ever wish to access a type of Google user data not described here, we will update this Privacy Policy and prompt you to consent before accessing that data.

4.2 How We Use Google User Data

We use Google user data solely to provide and improve the user-facing features you request, specifically:

  • to authenticate you and provide secure access to your SellerAI account using your Google email address and name;
  • to retrieve, display, and report on your Google Ads accounts, campaigns, and performance statistics inside the SellerClaw application; and
  • to create, launch, manage, and optimize your Google Ads campaigns on your behalf, at your direction, from within SellerClaw.

All Google user data is used solely for these business purposes. We do not use Google user data for any purpose that is not described in this Privacy Policy.

4.3 How We Share Google User Data

We do not sell, rent, or transfer Google user data to any third party. We do not share Google user data with advertising platforms, data brokers, or information resellers, and we do not use it for serving ads, retargeting, personalized or interest-based advertising, or to determine credit-worthiness or for lending purposes.

The only limited exceptions, consistent with the Google API Services User Data Policy, are where sharing is:

  • necessary to provide or improve the user-facing features described above, and then only with your consent;
  • necessary for security purposes, such as investigating abuse;
  • required to comply with applicable law; or
  • part of a merger, acquisition, or sale of assets, and then only after obtaining your explicit prior consent.

4.4 Limited Use and No Use for AI/Model Training

SellerAI's use and transfer to any other application of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

In particular, and notwithstanding any other statement in this Privacy Policy, we do not use Google user data to train, fine-tune, evaluate, or otherwise develop or improve any generalized or artificial-intelligence or machine-learning models, and we do not transfer Google user data to any third-party AI or model provider. The AI and model-training practices described in Sections 5 and 6 of this Privacy Policy do not apply to Google user data.

We do not allow humans to read Google user data except: (i) with your prior affirmative consent for specific data; (ii) where necessary for security purposes, such as investigating a bug or abuse; (iii) where necessary to comply with applicable law; or (iv) where the data has been aggregated and de-identified and is used for internal operations in accordance with applicable requirements.

4.5 How We Store and Protect Google User Data

Google user data is encrypted in transit and at rest. We maintain reasonable and appropriate administrative, technical, and organizational safeguards designed to protect Google user data against unauthorized or unlawful access, use, destruction, loss, alteration, or disclosure, and we limit access to authorized personnel who require it to operate the Services.

4.6 Retention and Deletion of Google User Data

We retain Google user data only for as long as necessary to provide the features you have requested. You may disconnect your Google account from SellerClaw at any time, which revokes our access to your Google user data. You may also revoke SellerAI's access directly through your Google Account at https://myaccount.google.com/permissions.

You may request permanent deletion of your Google user data at any time by disconnecting your Google account, using the deletion controls in your account settings, or contacting us at [email protected]. Upon disconnection or upon your deletion request, we permanently delete the associated Google user data promptly, and in any event within 30 days, except where retention is required by applicable law.

5. How We Use Personal Information

We may use personal information for the following purposes. Where any purpose below would otherwise apply to Google user data, the more specific and restrictive provisions of Section 4 control:

  • to provide, operate, maintain, and improve the Services;
  • to create and manage accounts;
  • to authenticate users and secure the Services;
  • to process subscriptions, payments, and related transactions;
  • to provide customer support, onboarding, and account communications;
  • to connect and operate third-party integrations such as Amazon Selling Partner API, eBay APIs, Shopify API, and Google APIs;
  • to facilitate store automation, workflows, analytics, recommendations, and other SellerClaw features;
  • to monitor usage, troubleshoot issues, detect fraud, abuse, and security incidents, and enforce our terms and policies;
  • to send administrative messages, service notices, updates, and other transactional communications;
  • to send marketing communications where permitted by law;
  • to personalize content, product experiences, and marketing;
  • to conduct internal research, testing, analytics, quality assurance, and product development;
  • to train, fine-tune, evaluate, improve, and support generalized AI models, internal models, and related machine learning systems used in connection with our business and Services, excluding Google user data, which is never used for these purposes;
  • to comply with legal obligations and respond to lawful requests; and
  • to protect the rights, property, safety, and security of SellerAI, our users, customers, service providers, and third parties.

6. AI and Model Training

Because SellerAI provides AI-enabled software and automation tools, we may use data submitted to or generated through the Services to train, fine-tune, evaluate, and improve generalized models and internal models, as well as related systems, features, and workflows.

This may include prompts, instructions, workflows, product data, store data, listing content, operational data, support interactions, and other information processed through the Services. We may use such information in identified, de-identified, aggregated, transformed, or other forms as part of product development and model improvement activities, subject to applicable law and our contractual commitments.

Google user data is excluded from all of the activities described in this Section 6. We do not use any data obtained through Google APIs to train, fine-tune, evaluate, develop, or improve any generalized or AI/ML models, and we do not transfer such data to any third-party model or AI provider. See Section 4.4.

You should not submit information to the Services unless you have the right to provide it for these purposes.

7. Cookies, Analytics, and Advertising Technologies

We use cookies and similar tracking technologies for operational, analytics, and advertising purposes. These technologies may be set by us or by our service providers and partners. These technologies operate on our website and Services and do not access Google user data obtained through Google APIs, which is governed exclusively by Section 4.

7.1 Essential and Functional Technologies

We use cookies and similar technologies that are necessary to operate the website and Services, maintain security, remember user preferences, support login functionality, and improve performance.

7.2 Analytics

We use Google Analytics and similar tools to understand how visitors and users interact with our website and Services, measure traffic and engagement, improve our content and features, and analyze usage trends.

7.3 Advertising and Marketing Technologies

We may use cookies, pixels, tags, and similar technologies for advertising, remarketing, attribution, conversion measurement, and marketing optimization. These tools may collect information about your interactions with our website or ads over time and across websites or services. We do not use Google user data obtained through Google APIs for advertising, remarketing, or interest-based advertising of any kind.

7.4 Your Choices

You may be able to control cookies through your browser settings, device settings, or a cookie consent or preference tool we may make available. Blocking certain cookies may affect the functionality of the website or Services.

8. How We Disclose Personal Information

We may disclose personal information in the circumstances described below. Disclosure of Google user data is limited to the narrow circumstances described in Section 4.3 and is never made for any other purpose.

8.1 Service Providers and Vendors

We may disclose personal information to vendors, contractors, subprocessors, and service providers that perform services on our behalf, such as hosting, infrastructure, analytics, payment processing, communications, customer support, security, and AI or machine learning processing.

8.2 Current Categories of Vendors and Platforms

Our current service providers and platforms may include:

  • DigitalOcean for cloud hosting and infrastructure;
  • Stripe for payment processing and billing-related services;
  • Google Analytics and related Google services for website analytics and advertising-related functionality;
  • OpenAI, Anthropic, Google, xAI, Groq, and Moonshot AI for AI, model, and related processing services; and
  • Amazon Selling Partner API, eBay APIs, Shopify API, and Google APIs in connection with authorized integrations and customer-requested functionality.

We do not share, transfer, or sell Google user data to any of the AI or model providers listed above, or to any other third party, except as expressly permitted in Section 4.3.

8.3 Integrations and Customer Instructions

When you connect third-party services, request an integration, or instruct us to process information through a connected service, we may disclose information as necessary to enable that functionality, subject to the limits in Section 4 for Google user data.

8.4 Legal Compliance and Protection

We may disclose personal information if we believe in good faith that doing so is necessary or appropriate to:

  • comply with applicable law, regulation, legal process, or governmental request;
  • enforce our agreements, policies, and terms;
  • detect, prevent, or address fraud, abuse, security incidents, or technical issues; or
  • protect the rights, property, safety, or security of SellerAI, our users, customers, or others.

8.5 Corporate Transactions

We may disclose personal information in connection with an actual or proposed merger, acquisition, financing, restructuring, sale of assets, bankruptcy, or other corporate transaction. With respect to Google user data, any such transfer will occur only after obtaining your explicit prior consent, as described in Section 4.3.

8.6 De-identified and Aggregated Information

We may use, disclose, and commercialize de-identified, aggregated, and statistical information that does not reasonably identify an individual, subject to applicable law and, with respect to Google user data, subject to the Limited Use requirements described in Section 4.4.

9. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain active accounts, comply with legal obligations, resolve disputes, enforce our agreements, improve the Services, and support business operations. Retention and deletion of Google user data are governed by Section 4.6.

As a general rule:

  • while an account remains active, we may retain associated account data, operational data, integration data, communications, and related records for as long as the account is active and as needed to provide the Services;
  • if an account is deleted, we generally delete associated personal information within 90 days, except where retention is required or permitted by law, needed for security, fraud prevention, dispute resolution, backup cycles, or to enforce our rights; and
  • we may retain de-identified or aggregated information for longer periods.

10. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. Personal information, including Google user data, is encrypted in transit and at rest.

However, no method of transmission over the internet and no method of electronic storage is completely secure. Accordingly, we cannot guarantee absolute security.

11. Your Privacy Choices

11.1 Account Information

You may update certain account information by logging into your account or contacting us.

11.2 Connected Google Account and Data Deletion

You may disconnect your Google account, revoke our access at https://myaccount.google.com/permissions, or request permanent deletion of your Google user data at any time, as described in Section 4.6.

11.3 Marketing Communications

You may opt out of receiving marketing emails from us by following the unsubscribe instructions in those emails. Even if you opt out of marketing emails, we may still send you transactional or service-related communications.

11.4 Cookies and Advertising

You may be able to control cookies and advertising technologies through your browser settings, device settings, ad settings offered by third parties, or a consent management tool we may provide.

11.5 Data Portability

Depending on the state in which you reside, you may have rights under applicable U.S. state privacy laws, which may include the right to:

  • know whether we process your personal information;
  • request access to personal information we hold about you;

  • obtain a copy of certain personal information in a portable format;
  • opt out of certain types of targeted advertising, profiling, or sales or sharing of personal information, where applicable; and
  • appeal certain privacy rights decisions, where required by law.

Because privacy laws vary by state and continue to evolve, the exact scope of rights available to you may depend on your state of residence and the nature of our relationship with you.

13. "Do Not Track" Signals

Some browsers offer a "Do Not Track" setting. Because there is not yet a universally accepted standard for responding to these signals, our website and Services may not respond to all "Do Not Track" signals in a consistent manner.

14. Children's Privacy

The Services are not directed to children under the age of 13, and we do not knowingly collect personal information directly from children under 13. If you believe a child under 13 has provided us with personal information, please contact us so that we can take appropriate steps.

15. Third-Party Services and Links

The Services may contain links to or integrations with third-party websites, apps, marketplaces, APIs, or services. We are not responsible for the privacy, security, or data practices of those third parties. Your interactions with those third parties are governed by their own terms and policies.

16. International Use

The Services are currently intended for users in the United States. If you access the Services from outside the United States, you understand that your information may be processed and stored in the United States and other jurisdictions where we or our service providers operate.

We may update this Privacy Policy from time to time. If we make material changes, we will post the updated version on this page and update the "Last Updated" date above. If we change the way we access or use Google user data, we will notify you and prompt you to consent to the updated Privacy Policy before we make use of Google user data in a new way or for a different purpose than originally disclosed. Where required by law, we may also provide additional notice.

Your continued use of the Services after an updated Privacy Policy becomes effective means that the updated Privacy Policy will apply to your future interactions with the Services.
